It's no joke for Kathleen Kane

One person who no doubt wishes today's news was some kind of April Fools' joke would be state Attorney General Kathleen Kane.

The state Supreme Court gave her a serious setback yesterday, ruling against her claim while saying a Montgomery County judge had the legal authority to appoint a special prosecutor to investigate her dealings - specifically leaks from her office.

That same grand jury, you may remember, recommended Kane face criminal charges in the case.

The ball now goes back into the lap of Montco District Attorney Risa Vetri Ferman. It will be her call as to whether or not to file charges against the state's top law enforcement officer.

Kane's spokesman Lanny Davis issued a statement on her behalf, saying that "we have faith in the judicial system and that the district attorney of Montgomery County will look at the evidence and the law and find that Attorney General Kane is innocent of any violations of the law."

The vote on the high court was 4-1 against Kane, with the only justice ruling in her favor being Judge Debra M. Todd. Another Democrat, Max Baer, joined his GOP colleagues Chief Justice Thomas Saylor, Michael H. Eakin and Correale Stevens in ruling against Kane.

Ferman has given no indication on a timetable for when she might rule on whether to file charges against Kane.
